During this extraordinary year of the COVID-19 pandemic, hospice providers continue to overcome many challenges as they provide care to terminally-ill patients and their families. CMS provided several waivers which eased some of the regulatory burdens hospices faced. However, there are more regulatory burdens to overcome in the future! On July 31, CMS issued the FY2021 Wage Index Final Rule, which answered “the big question” being asked by all who work in hospice: Will the October 1 implementation of the election statement and addendum requirements be delayed? The CMS answer was “No.” There will be no delay in the October 1 implementation date for hospices to modify the election statements they use and to provide, upon request, the election statement addendum form which must list those items, services, and drugs the hospice has determined to be unrelated to the terminal illness and related conditions. The CMS stated goal for requiring hospices to use this new form is to increase coverage transparency for beneficiaries under a hospice election. To meet this new requirement, hospices will need to operationalize how they will provide a written list and a rationale for the conditions, items, drugs, or services that the hospice has determined to be unrelated to the terminal illness and related conditions.

As NHPCO’s Vice President, Regulatory and Compliance, Judi Lund Person, MPH, CHC serves as a key contact with the Centers for Medicare and Medicaid Services, ensuring NHPCO’s voice is heard with policymakers and interfacing with hospice payment policy, Part D, survey and certification, contractor management, and program integrity functions, among others.  Judi led the organization through the release and implementation of the Medicare Hospice Conditions of Participation in 2008 and develops tools each year for hospice providers, including hospice payment rates and wage index values. She works daily with hospice providers and state hospice organizations on the ever-increasing array of regulatory and compliance issues and translates complex regulatory language into actionable “plain English” for hospice providers.  Prior to joining the team at NHPCO, she served for 22 years as the President and CEO of The Carolinas Center for Hospice and End of Life Care, and was an early advocate for the passage of the Medicare Hospice Benefit in Congress.

CONTINUING EDUCATION   There are 1.5 Continuing Education Contact Hours Provider approved by California Board of Registered Nursing, Provider CEP14488. This program has been approved for 1.5 CEUs by the NASW Washington State Chapter.  Licensed Social Workers, Marriage and Family Therapists and Mental Health Counselors are eligible.  Provider number #1975-153.
